IRS Tax Relief 2025: Extended Deadlines for Farmers and Ranchers Affected by Drought

Farmers and ranchers across the U.S. who were forced to sell livestock because of severe drought now have more breathing room when it comes to taxes.

On September 22, 2025, the Internal Revenue Service (IRS) announced a special tax relief program for producers in drought-stricken areas.

The relief lets qualified taxpayers defer capital gains taxes from forced livestock sales and gives them extra years to replace their herds.

 

How the IRS Tax Relief Works

Normally, when livestock is sold due to drought, the farmer has just two years to replace the animals to avoid paying taxes on the gains. The new IRS rule changes that:

  • The deadline is now four years.

  • The replacement period may be extended further if drought conditions continue.

  • Relief applies only to animals used for breeding, dairy, or draft purposes, not poultry, sport animals, or livestock raised solely for slaughter.

Who Qualifies in 2025?

  • Eligible Areas: Covers 49 states and D.C., excluding only Alaska.

  • County Requirements: Your county must be listed in IRS Notice 2025-52 as having exceptional, extreme, or severe drought.

  • Proof of Drought Impact: You must show the livestock sale was a direct result of drought conditions.
